The IEC catalog says IEC 61508-3:2010 applies to any software forming part of a safety-related system or used to develop a safety-related system. It requires that software safety functions and software systematic capability are specified, and it sets requirements for support tools. The page lists it as a basic safety publication; so does the entry for IEC 61508-1:2010.

ISO/IEC TR 5469:2024, titled “Artificial intelligence — Functional safety and AI systems”, describes properties, risk factors, methods and processes relating to three areas: using AI inside a safety-related function, using non-AI safety-related functions to keep an AI-controlled piece of equipment safe, and using AI systems to design and develop safety-related functions.

Editorial judgment: The three TR 5469 areas are a useful way to sort vendor claims. A SIL-qualified code generator (see TESSY and CODESYS Virtual Safe Control SL) sits under the third area or in the tool support category. It does not put a trained model in the first area. We have not found an official IEC sentence that confers a SIL on a machine-learning model.
