Motor-vehicle AI under the AI Act — Annex I Section B and Article 2(2)
Informational only, not professional or legal advice. Facts are linked to the source we checked; statuses can change after the date above.
On the Commission’s AI Act Service Desk Annex I page, titled “List of Union harmonisation legislation”, Section B lists Regulation (EU) 2018/858 on approval and market surveillance of motor vehicles and Regulation (EU) 2019/2144 on type-approval requirements for motor vehicles (general safety).
Article 6 classifies an AI system as high-risk where it is a safety component of a product, or is itself a product, covered by Annex I legislation, and that product needs a third-party conformity assessment. For systems tied to Section B legislation, Article 2(2) states that only Article 6(1), Article 60a and Articles 102 to 112 apply, and that Articles 57, 58 and 59 apply only in so far as the requirements for high-risk AI systems are integrated into that harmonisation legislation.
We have not found an official sentence on those pages that links ISO/PAS 8800:2024 to AI Act conformity, or that makes the PAS a harmonised standard. The ISO catalog page describes the document’s subject (safety-related behaviour of AI in series-production road vehicles), not its legal status.
Editorial judgment: For a supplier selling AI components into vehicles, the practical reading of these pages is that the vehicle type-approval regulations, not the AI Act’s Chapter III requirements directly, are where AI-specific obligations for Section B products would be added. Confirm the current position with counsel and the type-approval authority; this directory does not give legal advice.
Listings are tagged to ISO/PAS 8800 only when the cited vendor page names it. Parasoft C/C++test and UL Stages name it. Ansys medini analyze names ISO 26262, not the PAS.
